1. Acceptance of Terms

By accessing or using the WISMO platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including those on the early access waitlist.

2. Description of Service

WISMO is a social commerce automation platform that helps Instagram sellers automate customer communication, manage order tracking, sync product catalogs, and handle post-purchase operations. The Service connects to your Instagram Business account via Meta's official API.

3. Eligibility

To use WISMO, you must be at least 18 years old and have a valid Instagram Business account. By using the Service, you represent and warrant that you meet these requirements and that all information you provide is accurate and current.

4. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at wismo.connect@gmail.com if you suspect any unauthorised use of your account. We cannot be held liable for any loss or damage arising from your failure to protect your credentials.

5. Acceptable Use

You agree not to use WISMO to:

• Send spam, unsolicited messages, or harass customers.
• Violate Meta's Platform Policies or Instagram's Community Guidelines.
• Misrepresent your identity or business to customers.
• Engage in fraudulent, deceptive, or illegal activity.
• Reverse-engineer, scrape, or attempt to extract our source code or data.
• Resell or redistribute the Service without written permission.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

6. Instagram & Meta Compliance

WISMO operates through Meta's official API. Your use of WISMO must comply with Meta's Platform Terms and Instagram's policies at all times. We are not responsible for changes Meta makes to their API or policies that affect the Service. If Meta restricts or revokes API access, we will notify you and work to restore service as quickly as possible.

7. Subscription & Billing

WISMO is currently in early access. Pricing details will be communicated before any charges are applied. By joining the waitlist, you are not committing to any payment. When paid plans launch, billing terms and cancellation policies will be clearly stated at the time of subscription.

8. Intellectual Property

All content, features, and functionality of the WISMO platform — including the software, design, logos, and text — are the exclusive property of WISMO and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

You retain ownership of all data you upload or generate through WISMO (product catalogs, order data, customer messages). By using the Service, you grant us a limited licence to process this data solely to provide the Service to you.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for any lost sales, missed messages, or business outcomes arising from use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, WISMO and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of revenue, data, or business opportunities — arising from your use of the Service, even if we have been advised of the possibility of such damages.

11. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your access if you breach these Terms, violate applicable law, or engage in behaviour harmful to other users or the platform. Upon termination, your right to use the Service ceases immediately.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notice at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
